1. General Risk Warning
Trading futures involves substantial risk of loss and is not suitable for all investors. You should carefully consider whether futures trading is appropriate for you in light of your financial condition, investment experience, and risk tolerance.
The high degree of leverage available in futures trading can work against you as well as for you. The use of leverage can lead to large losses as well as large gains. You could lose more than your initial investment.
Do not trade with money you cannot afford to lose. The Strategy Factory makes no guarantees about the profitability of any trade, signal, or strategy.
2. CFTC Rule 4.41 — Hypothetical Performance Disclaimer
Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not been executed, the results may have under-or-over compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profit or losses similar to those shown.
This disclaimer is required by the Commodity Futures Trading Commission (CFTC) and applies to all performance data presented by The Strategy Factory, including backtested results, walk-forward validation results, and any hypothetical trade records.
3. Simulated vs. Actual Performance
The performance results displayed on our website, Discord, and marketing materials are based on backtested and simulated trading results unless explicitly stated otherwise. These results were generated by applying our algorithms to historical market data.
Important limitations of backtested data include:
- Hindsight bias — Strategies are developed with knowledge of past price action. Parameters may have been optimized (intentionally or inadvertently) to fit historical data.
- Execution assumptions — Backtests assume fills at signal prices. In live markets, slippage, partial fills, and execution delays are unavoidable.
- Liquidity assumptions — Historical data may not reflect periods of low liquidity where orders would have moved the market.
- Commission estimates — While our results include commission estimates, your actual commission costs may differ based on your broker.
- Survivorship bias — Only the strategies that "survived" development and testing are presented. Failed strategies are not shown.
We use walk-forward validation to test our strategies on out-of-sample data. While this is a more rigorous methodology than simple backtesting, it still does not guarantee future performance.
4. No Guarantee of Results
Past performance is not indicative of future results. This is not a disclaimer we bury in fine print — it is a fundamental truth of trading.
Market conditions change. Strategies that performed well in backtesting or during specific time periods may underperform, break even, or lose money in the future. Factors that can cause strategies to degrade include:
- Changes in market microstructure, volatility, or correlation
- Shifts in monetary policy, economic conditions, or geopolitical events
- Increased adoption of similar strategies, reducing edge
- Regulatory changes affecting futures markets
We monitor our strategies continuously and will communicate with subscribers if significant performance degradation is observed. But we cannot predict when or if this will happen.
5. Leverage & Margin Risk
Futures are leveraged instruments. A relatively small market movement can have a proportionally larger impact on the funds you have deposited or will have to deposit.
- You can lose more than your initial margin deposit. If the market moves against your position, you may be required to deposit additional funds (margin call) on short notice to maintain your position.
- Failure to meet margin calls may result in your broker liquidating your position at a loss — without your consent.
- Leverage amplifies both gains and losses. A 1% move in the underlying market can translate to a 10%+ move in your account, depending on the margin requirements.
The Strategy Factory signals do not account for your individual account size, margin requirements, or risk tolerance. Position sizing and risk management are your responsibility.
6. Signal Service Limitations
Our signal delivery system, while designed for reliability, is subject to the following limitations:
- Latency: Signals are delivered via Discord. There is inherent latency between signal generation and delivery. Market conditions can change in the seconds between when a signal fires and when you see it.
- Technology failures: Discord outages, internet connectivity issues, server downtime, or software bugs can delay or prevent signal delivery.
- Execution gap: Even if you receive a signal instantly, your actual execution depends on your broker's platform, your internet connection, order routing speed, and available liquidity.
- Slippage: The price at which you fill your order may differ from the signal price, especially during volatile market conditions or around news events.
- Partial signals: System errors may result in entry signals without corresponding exit signals, or vice versa. Always have a contingency plan.
We are not responsible for any losses resulting from signal delivery delays, technical failures, or execution differences between the signal and your actual trade.
7. Not Financial Advice
The Strategy Factory is not a registered investment advisor, commodity trading advisor, broker-dealer, or financial planner. We are not registered with the SEC, CFTC, NFA, or any state securities regulator.
Nothing provided through the Service — including signals, performance data, educational content, Discord messages, tweets, or any other communication — constitutes:
- Personalized investment advice
- A recommendation to buy, sell, or hold any futures contract
- An offer to manage your money or execute trades on your behalf
- A guarantee or promise of investment returns
All signals are generated algorithmically and are provided for informational and educational purposes only. They are not tailored to your individual financial situation, investment objectives, or risk tolerance.
8. You Are Responsible
By using The Strategy Factory, you acknowledge that:
- All trading decisions are yours alone. Whether to enter, exit, or modify a trade is entirely your decision.
- You are responsible for your own due diligence before placing any trade.
- You should consult with a qualified financial advisor, tax professional, or legal counsel before making investment decisions.
- You are responsible for understanding and complying with all applicable laws and regulations regarding futures trading in your jurisdiction.
- You are responsible for your own risk management, including position sizing, stop-loss placement, and portfolio allocation.
We provide signals. What you do with them is entirely up to you.
9. Capital at Risk
Only trade with capital you can afford to lose entirely.
Do not use rent money, emergency funds, retirement savings, borrowed money, or funds earmarked for essential expenses to trade futures. Trading should only be done with true risk capital — money that, if lost completely, would not materially affect your lifestyle or financial security.
If you find yourself trading with money you can't afford to lose, or if trading is causing you significant stress or anxiety, stop trading and seek professional guidance.
